These Terms of Service (the "Terms") set the rules for using the website Novaryx and AI trading platform, together called the "Service", operated by Novaryx Inc. ("Novaryx", "we", "us", or "our"). Using or accessing the Service means you accept these Terms. If you do not accept them, do not use the Service.
1. Who May Use the Service
You must be 18 or older to use the Service. By entering it, you confirm that you meet this age requirement and can legally accept these terms. Access is unavailable wherever applicable law forbids it.
2. Opening an Account
Full access requires an account containing complete and current information. You must keep your credentials secure and are responsible for activity conducted through your account. Tell us promptly at if you believe someone has accessed it without permission.
We can suspend or terminate accounts that breach these terms, use inaccurate information, or are connected with abuse or fraudulent conduct.
3. Service Scope and Restrictions
Novaryx offers AI-generated market analysis, trading signals, and optional automated execution through connected brokerage accounts. The Service is supplied for analysis and information only.
- Novaryx does not custody or control your funds; your capital remains with your brokerage or exchange.
- Brokerage connections use API keys that may permit read access and trade execution. They do not provide permission to withdraw funds.
- Earlier strategy or signal performance is not a reliable indication of future outcomes.
- Trading carries financial risk, including the possibility of losing your Novaryx capital.
4. No Financial Advice
Nothing provided through the platform Novaryx is financial, investment, or trading advice. AI outputs and analysis are informational only. Seek guidance from a suitably qualified financial professional before committing funds. Novaryx is not registered as an investment adviser, broker, or financial planner.
5. Charges and Payments
Some Service functions are available only through a paid subscription. Pricing appears on the pricing page and may be amended with 30 days' notice. Taxes are not included and remain your responsibility. Plans are paid in advance monthly or annually. At our discretion, a refund may be available to a new user within 14 days of the first payment.
6. Rules for Acceptable Use
You must not:
- Use the Service unlawfully or contrary to applicable regulations.
- Reverse engineer the platform or try to obtain its source code.
- Scrape or collect Service information through automated means.
- Resell or commercially misuse the Service without written authorisation.
- Interrupt, damage, or obstruct the Service or its underlying infrastructure.
- Carry out market manipulation, front-running, or another unlawful financial activity.
7. Intellectual Property
All software, materials, algorithms, marks, and confidential business information offered through the Service belong solely to Novaryx or its licensors. These Terms do not give you permission to use our logos or trademarks without written consent.
8. Warranty Exclusions
THE SERVICE IS OFFERED "AS IS" AND "AS AVAILABLE", WITH NO EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Novaryx WE DO NOT PROMISE THAT THE SERVICE WILL OPERATE WITHOUT INTERRUPTION OR ERRORS, OR THAT IT WILL BE FREE OF VIRUSES OR OTHER HARMFUL ELEMENTS.
9. Limits on Liability
TO THE MAXIMUM EXTENT ALLOWED BY LAW, Novaryx WE WILL NOT BE RESPONSIBLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE LOSS, INCLUDING LOST PROFITS, DATA, TRADING LOSSES, OR BUSINESS INTERRUPTION, ARISING FROM SERVICE USE, EVEN IF WE WERE WARNED SUCH LOSS COULD OCCUR. OUR TOTAL LIABILITY WILL NOT EXCEED WHAT YOU PAID TO Novaryx DURING THE PRECEDING 12 MONTHS.
10. Your Indemnity Obligations
You agree to protect and indemnify Novaryx and its staff against claims, losses, damages, and costs resulting from your Service use or violation of these Terms.
11. Closing an Account
You can close your account through settings at any time or by contacting . We may end or suspend access immediately after a breach of these terms. When access ends, the Service is no longer available and data may be removed in line with the Privacy Policy.
12. Applicable Law and Disputes
New York State law governs these terms, excluding its conflict-of-law principles. Disputes will be determined through binding arbitration in Victoria Island, Lagos, Nigeria under American Arbitration Association procedures. Users in the EU or UK may bring claims before their local courts.
13. Amendments to These Terms
We may revise these terms from time to time. Material changes will normally be notified at least 14 days in advance by email or through the platform. Continuing to use the Service after an update indicates acceptance.
